TERMS AND CONDITIONS
1. Sending & Return of Your Source Media
We advise you to use a reputable delivery service requiring signature on delivery or recorded service when sending your media to us. We use MyHermes to return your completed transfers and a variety of reputable overnight couriers for our next day delivery service.
2. Safety of Your Source Material
We always take exceptional care with your tapes. In the unlikely event of us causing damage to your material, we will compensate you up to the purchase value of the original media. Please Note: This does not apply to tapes that have arrived to us in a damaged or unusable state or tapes that are damaged during playback due to defects or general age.
3. DVD Player Compatibility & Guarantees
The DVD discs that we use are industry standard Grade A - the highest quality. The playback compatibility of these discs are exceptionally high. If you experience a problem with your order you must contact us within 7 days, describing the problem. Timeless Memories will not be held responsible for damaged / mishandled discs or incompatible players. It is the customer's responsibility to protect the supplied DVDs from scratches or other damages.
4. Quality of your source material
Tapes arrive to us in different states of condition. If your tapes are unplayable, suffer from heavy oxidisation, damaged, snapped or we feel they cannot be transferred successfully we will contact you first. We operate a 90/10 ratio which means on transferring your tapes we allow for a certain amount of possible tape artefacts to be present but to not spoil watchability. Tape artefacts can be impossible to remove due to 1. The condition of the tapes. 2. How they have been stored. 3. Sun & Light damage. 4. Water & Moisture damage. 5. Oxidisation. 6. Weak tape signal. 7. General age of the tape.
5. Your Responsibility
WE WILL NOT ACCEPT and it is your responsibility to ensure, that the source media supplied SHALL NOT contain material classed as 'Prohibited Content' and must comply with current laws of shipping audio/visual material.
Prohibited Content: Generally, Prohibited Content includes (without limitation) any of the following types of Content:
- Content we believe is abusive, deceptive, pornographic, obscene, defamatory, slanderous, offensive, or otherwise inappropriate.
- Copyrighted material that is used without the express permission of the owner.
- Content that violates or encroaches on the rights of others.
- Content or other material that contains viruses, worms, corrupt files, Trojan horses and other forms of corruptive code or any other content, which may compromise our service.
- Content that advocates illegal activity.
- Content that harms minors in any way.
Timeless Memories reserves the right to pass any infringements of this Prohibited Content that we may receive to the relevant authorities if it is deemed necessary.
6. Money Back Guarantees
Any "Money Back Guarantees" if made, exclude any incurred delivery charges both inwards and outwards unless stated otherwise.
We will archive your CD / DVD transfer for up to 1 year in a safe and secure vault. We do not guarantee archival discs against natural disasters, war or acts of terrorism.
Timeless Memories will not be liable for any economic losses (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings), any loss of goodwill or reputation, or any special, indirect or consequential damages (however arising, including negligence) arising out of or in connection with this Agreement.
All prices quotes are in UK Pounds (GBP) unless stated otherwise.
11. Methods and Terms of Payment
Timeless Memories can be paid securely using PayPal or by sending a cheque made payable to “Timeless Memories”.
12. Over-Payments & Under-Payments
Should your order be underpaid we will continue to carry out your conversion and contact you for further payment. Over-payments of £2.00 or less are NOT refunded due to handling costs.
13. Postage Charges
Postage charges are your responsibility when sending your source media to us.
In the event that your media arrives to us damaged we will alert you. We are not responsible for items damaged or lost by the postal services. Always provide the correct return postal address to minimise this risk. If you have reason to believe damage has occurred then you must take this up with the postal service.
15. Refund Policy
If you have a genuine reason to claim a refund please contact us by email. We will review your claim and if we find it to be justified we will refund you (less postage) by the same method of payment from which you originally paid.
